Terms of Service

1. Agreement

These Terms are an agreement between you and Dardesh ("Dardesh", "we", "us"). They cover this website, getdardesh.com, and our dictation software: the macOS app, and the iPhone keyboard and Windows app as they become available (together, the "Service"). By joining the waitlist, creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Dardesh records your voice when you ask it to, sends the audio for transcription, and inserts the resulting text where your cursor is. It can also translate a transcript, attach screenshots you capture while dictating, and rewrite a transcript in another style.

The Service is opening in stages: the Mac app first, then the iPhone keyboard, then Windows. Features and platforms described as "coming soon" are plans, not promises of a date. Versions marked beta or early access may change or contain errors.

3. Waitlist

Joining the waitlist is free and does not guarantee access by any date. We use your email only to send your invite and news about your access. You can ask to be removed at any time.

4. Your account

• You must be at least 16 years old, and old enough to enter a contract where you live.
• Give accurate information and keep your sign-in details safe. You are responsible for activity on your account.
• An account is for one person. Do not share it or resell access.

5. Plans, billing and renewal

• Price. Plans, prices, included usage and any free trial are shown before you pay. Prices may exclude taxes, which are added where required.
• Renewal. Subscriptions renew automatically at the end of each billing period until you cancel.
• Cancelling. You can cancel at any time. You keep access until the end of the period you have paid for, and you are not charged again.
• Usage limits. Plans may include a fair-use limit on dictation time. We show your usage in the app.
• Price changes. If we change the price of your plan, we will tell you at least 30 days before your next renewal, and you can cancel before it applies.
• Payment provider. Payments are handled by our payment provider, which may be the seller of record for your purchase. Its terms apply to the payment itself. Purchases made through Apple's App Store are billed by Apple under Apple's terms.

6. Refunds

If you are not satisfied, write to hello@getdardesh.com within 14 days of your first payment and we will refund it in full. Renewal payments are not refunded once the new period has started, except where the law requires it or the Service was unavailable through our fault. Refunds for App Store purchases are handled by Apple. Nothing here limits rights you have under consumer law in your country.

7. Your content

You own your audio, your screenshots and the text Dardesh produces from them. You give us permission to process them only as needed to provide the Service to you: to transcribe, translate or rewrite them and return the result. We do not use your content to train AI models. See the Privacy Policy for details.

You are responsible for what you dictate and capture, including making sure you have the right to record anyone else whose voice is picked up and to capture what is on your screen.

8. Acceptable use

You agree not to:

• use the Service for anything unlawful, or to record people without the consent the law requires;
• try to break, overload, reverse engineer or get around the limits of the Service;
• use automated means to send audio that is not real dictation, or resell the Service;
• use the Service to build a competing product.

9. Accuracy

Transcripts, translations and rewritten text are produced by AI and can contain mistakes: a misheard word, a wrong number, a changed meaning. Read the text before you send or rely on it, especially for legal, medical, financial or safety-related matters. Dardesh is a writing aid, not a professional service.

10. Our software

We give you a personal, non-transferable licence to install and use the Dardesh apps on devices you control, for as long as you follow these Terms and, for paid features, keep an active plan. The Service, its software, name and design belong to Dardesh. The apps need certain system permissions (such as Microphone and Accessibility) to work; you can withdraw them in your system settings at any time, and some features will stop working if you do.

11. Other services

Dardesh works with apps and services run by others, including the AI provider that performs the transcription and the apps you paste text into. We are not responsible for those services, and their own terms apply to your use of them.

12. Availability and changes

We work to keep the Service running, but we do not promise it will be uninterrupted or error-free. We may add, change or remove features. If we make a change that materially reduces a paid plan, we will tell you beforehand, and you may cancel and receive a refund for the unused part of the period you have paid for.

13. Suspension and ending

You can stop using the Service and close your account at any time. We may suspend or close an account that breaks these Terms, puts the Service or other users at risk, or has unpaid charges. Where it is reasonable, we will warn you first and give you a chance to fix the problem.

14. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

15. Limit of liability

To the extent the law allows, Dardesh is not liable for indirect, incidental or consequential losses, or for lost profits, data or business. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer.

16. Changes to these Terms

We may update these Terms as the Service grows. When a change is significant, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using the Service after that, you accept the new Terms.

17. General

If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a term, that is not a waiver of it. You may not transfer your account or these Terms to someone else; we may transfer them as part of a merger or sale of the Service. These Terms are governed by the laws of the country in which Dardesh is established, without affecting any mandatory protections of the country where you live.
